These Terms & Conditions ("Terms") govern your use of 416funko.com and purchases from 416Funko ("416Funko," "we," "us," or "our"). By using the site or submitting an order, you agree to these Terms and our Privacy Policy.

Store and eligibility

416Funko is an independent collectibles reseller operating from Florida, United States. You must be legally able to enter a contract in your jurisdiction to place an order. We may decline or cancel an order for suspected fraud, pricing or inventory errors, shipping restrictions, or other legitimate business reasons. If we cancel after payment, we will issue an appropriate refund.

Products, condition, and references

Collectibles may have manufacturing variations or box wear. We aim to describe condition accurately and use photographs of the actual item where stated. Please review the listing and ask questions before ordering. Screen settings may affect color. Soft protectors are included where the listing says so.

Links labeled “Official Funko reference” lead to third-party manufacturer pages for identification or background only. 416Funko does not copy or hotlink those product images, and a reference link does not imply sponsorship or endorsement. Funko, Pop!, character names, and related marks belong to their respective owners. 416Funko is not affiliated with or endorsed by Funko, LLC unless expressly stated.

Prices, payment, and taxes

Prices are shown in U.S. dollars unless stated otherwise and may change before an order is submitted. Applicable shipping charges and taxes are displayed during checkout. Payments are processed by Stripe or another identified processor. You authorize the processor to charge the selected payment method for the order total.

Inventory and order confirmation

Inventory is limited and may sell through another channel before the site updates. An order acknowledgment does not guarantee acceptance. The order is accepted when payment is successfully processed and we confirm fulfillment. Quantity limits may apply.

Shipping and delivery

Available services, estimated rates, and delivery windows are supplied through Shippo and participating carriers using the destination, parcel, and order details. Estimates are not guarantees. Delays caused by carriers, weather, customs, incorrect addresses, or events outside our reasonable control may occur.

Customers are responsible for providing a complete deliverable address. International customers are responsible for import duties, taxes, brokerage fees, and customs requirements unless checkout expressly states otherwise. Please contact us promptly about a lost, damaged, or misdelivered shipment so we can help with the carrier claim.

Local pickup

A Cape Coral-area pickup or meetup may be offered by prior arrangement. Exact meeting details are shared privately after confirmation. Availability, scheduling, identification, and reasonable safety requirements may apply.

Returns, damage, and refunds

You may request a return within 14 calendar days after confirmed delivery by emailing chris@incendiarymedia.com. The item, original box, included protector, inserts, and accessories must be returned in the same condition received. Items marked final sale, personalized items, and items altered after delivery are not eligible except where required by law.

• For a change-of-mind return, the customer is responsible for tracked return shipping, and original shipping charges are not refundable.
• If the wrong item arrives, the shipment is damaged, or the item is materially different from its listing, contact us within seven days with clear photos of the item and shipping packaging. We will provide an appropriate replacement, return label, partial refund, or full refund based on the circumstances.
• Approved refunds are issued to the original payment method after the return is received and inspected. Bank processing time may vary.

Acceptable use

You may not misuse the site, attempt unauthorized access, disrupt checkout, scrape the catalog at scale, submit fraudulent orders, infringe intellectual-property rights, or use the site for unlawful activity.

Disclaimers and limitation of liability

To the extent permitted by law, the site is provided “as is” and “as available.” We do not guarantee uninterrupted operation or that every listing error will be detected before purchase. To the extent permitted by law, 416Funko will not be liable for indirect, incidental, special, or consequential damages. Our total liability arising from an order will not exceed the amount paid for that order. Nothing in these Terms excludes rights or remedies that cannot legally be excluded.

Governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally will be handled in a court with appropriate jurisdiction in Florida, except where applicable consumer law requires otherwise.

Changes and contact

We may update these Terms as the store evolves. Changes apply prospectively when posted, and the effective date above identifies the current version. Questions, order concerns, and return requests may be sent to chris@incendiarymedia.com.
